It is, in a sense, a concept album. But unlike Ziggy Stardust or OK Computer, the concept isn't in the music, though the songs are pretty great. It's in the fine print. All the songs come with a license that gives you permission to do more than just listen to them. You can swap them. You can sample them. You can use them to fuel your own creative impulses, without worrying that the copyright cops will beat down your door.

A edição da Wired de novembro chega às bancas querendo revolucionar a indústria fonográfica, que ultimamente tem jogado duro para coibir a troca de músicas através da web e redes P2P. Sob o título Sample the future, a revista traz consigo um CD que contém músicas de bandas como Beastie Boys, David Byrne, Le Tigre e até nosso ministro Gilberto Gil, que abriram mão de seus direitos em prol da nova proliferação digital. Basicamente, podemos samplear, mixar, distribuir, e em alguns casos até cobrar pelas obras modificadas, sem infringir qualquer lei autoral.

Isso é possível por estarem inseridas em licenças de uso criadas pelo Creative Commons, uma organização sem fins lucrativos que propõe a flexibilização dos direitos autorais para permitir uma maior cooperação entre autores/artistas. Em todas as modalidades de licença disponíveis, o cerne é garantir a livre distribuição da obra, mantendo a autoria porém sem restringir o acesso.

As músicas contidas no CD da Wired encontram-se em duas licenças específicas para o audio: uma que permite a distribuição não-comercial através de qualquer meio e o uso de trechos dessas obras para criar algo novo; e outra que vai além, permitindo que esse algo novo seja distribuído comercialmente. Para os publicitários de plantão já saltitando pra usar as canções na sua próxima campanha, uma ressalva: esse distribuição comercial não contempla o uso em propagandas e anúncios. Boo-hoo, who cares, a questão principal disso tudo é divulgar a arte, e incentivar novas criações.

So here are 16 songs that encourage people to play with their tunes, not just play them. Sixteen artists who recognize that digital culture can be an advantage, not a threat. By contributing a track to The Wired CD, these musicians acknowledge that for an art form to thrive, it needs to be open, fluid, and alive. They have made the simple statement that when it comes to copyright, they are pro-choice. These artists - and soon, perhaps, many more like them - would rather have people share their work than steal it.
